DENPASAR | The high risk of legal issues in resolving legal cases led Perum Penjaminan Kredit Indonesia (Jamkrindo) to finally decide to collaborate with the High Prosecutor's Offices (Kejati) across Indonesia.

This cooperation is aimed at resolving legal cases related to claims and subrogation, which has been outlined in a memorandum of agreement and signed by both parties in Kuta on Wednesday (31/8).

Perum Jamkrindo President Director Diding S. Anwar, during the signing of the cooperation, stated that the potential for subrogation (debt repayment by a third party), in this case, problematic credit guaranteed by Perum Jamkrindo, is very significant. The total subrogation balance of Perum Jamkrindo as of July 31, 2016, had almost reached more than Rp 4.2 trillion.

"During the period from January to July 2016, the company recorded subrogation revenue of Rp 127 billion, while the claims paid during the same period amounted to Rp 455 billion," he said.

Seeing this substantial subrogation potential, Diding acknowledged that Perum Jamkrindo requires legal assistance in the Civil and State Administrative sectors from the High Prosecutor's Offices. The assistance includes providing legal aid, legal considerations, and taking other legal actions. "With this cooperation, especially in handling legal issues in the Civil and State Administrative sectors, it becomes even more relevant.

Particularly in enhancing legal insight and knowledge, awareness, or prudence in making claim decisions," he explained, ensuring that risk mitigation and the safeguarding of state finances can be carried out from an early stage. Additionally, he stated that the cooperation with the Prosecutor's Office is also essential when Jamkrindo receives legal notices and lawsuits from guaranteed partners.

"We need a legal opinion from the Prosecutor's Office to minimize legal risks and ensure that claim decisions made do not violate applicable laws and regulations," he explained.

Furthermore, Diding mentioned that the signing of the cooperation with the Prosecutor's Office, in this case, the Junior Attorney General for Civil and State Administrative Affairs (Jamdatun), is planned to be carried out in three batches. The first batch had previously been conducted in Makassar on May 4, 2016. "For the second batch, it is being conducted in Denpasar," he revealed.

Meanwhile, Jamdatun, Bambang Setyo Wahyudi, stated that he did not encounter any significant issues in assisting Perum Jamkrindo.

Diding added that with this cooperation, the synergy between Perum Jamkrindo and the Prosecutor's Office can effectively protect the management of state finances. "At the same time, safeguarding state finances from an early stage," he concluded. (Source: Radar Bali)
